This manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA). It explains what records THRIVE SA (PTY) LTD holds and how to request access to them.

Legislation under which records are kept includes the Companies Act 71 of 2008, the Income Tax Act 58 of 1962, the Value-Added Tax Act 89 of 1991, the Basic Conditions of Employment Act 75 of 1997, the Labour Relations Act 66 of 1995, the Consumer Protection Act 68 of 2008, the National Credit Act 34 of 2005 and POPIA.

5. How to request a record

  1. Complete the prescribed PAIA request form (Form 2, available from the Information Regulator's website).
  2. Send it to privacy@thrivesa.co.za, marked for the attention of the Information Officer.
  3. Provide enough detail to identify the record and to identify yourself, and state the form of access you want and how you want to be told the outcome.
  4. If you are asking on behalf of someone else, attach proof of your authority.
  5. State which right you are seeking to exercise or protect, and why the record is needed for it.

We will decide within 30 days and tell you the outcome and any fee. That period may be extended by a further 30 days where the request covers a large number of records, and we will tell you if it is.

6. Fees

A request fee and an access fee may apply, at the rates prescribed in the PAIA regulations. A personal requester — someone asking for their own personal information — does not pay a request fee. We will tell you what is payable before we process the request, and we may require a deposit where preparation is expected to take more than six hours.

If you only want a copy of the personal information we hold about you, or want it corrected or deleted, the simplest route is a POPIA request to privacy@thrivesa.co.za — that is free and is normally answered within 30 days. See our Privacy Policy.

7. Grounds for refusal

Access may be refused on the grounds set out in Chapter 4 of PAIA, including the protection of someone else's personal information, commercially confidential information, information given in confidence, legally privileged records, and research information. Where part of a record may be refused, we will give you the rest.

8. If we refuse

We will give reasons. You may then complain to the Information Regulator, or apply to a court, as PAIA provides.
